Pre-filing Consultation

Our patent consulting services cover all aspects of patent prosecution such as patentable subject matter determination, PCT international application and the Chinese national phase entry procedures, comparisons between filing applications in China via the Paris Convention route and/or the PCT route, priority-claim requirements and strategies, comprehensive filing arrangements under a patent for invention, patent for utility model and/or patent for industrial design, divisional applications, PPH, etc.

Patent Drafting and Prosecution

It includes drafting patent specification (for invention patents, utility model patents and design patents), handling patent filing and examination procedures, analyzing and drafting response to Office Actions and handling patent granting procedures.

Patent Re-examination

Upon clients’ requests, China Sinda prepares re-examination documents, handles the re-examination submission procedures and forwards and responds to notifications of re-examination. China Sinda also advises on and handles post-reexamination procedures including appealing to higher judicial level for administrative litigation against the re-examination decision.

Patent Invalidation

China Sinda represents clients before the Re-examination and Invalidation Department and in court in patent invalidation and administrative litigation proceedings, including invalidation of a third party’s patent, and defence the client’s patent in an invalidation action initiated by a third party. The joint efforts of the patent prosecution practice team and its co-operative law firm, Sinda Law Office, makes China Sinda an expert in handling post-grant proceedings and patent invalidation actions. Our strategies and advice are tailored to support clients’ objectives, whether it is to invalidate competitors’ patents or to defend the client’s patent in invalidation actions.

Patent Litigation

China Sinda has notable success in patent infringement litigation. The multi-disciplinary team combines expertise and experience in laws and regulations, evidence collections and court appearances, as well as expertise in patent law and technology, in either offensive or defensive strategies.

Landmark cases successfully represented by China Sinda include:
1. Wuhan Jingyuan Environmental Engineering Co., Ltd. vs. Japan Fuji Kasui Industry Co., Ltd. and Huayang Electric Power Co., Ltd.. The case had been selected as one of the “Top 10 Cases of Judicial Protection of Intellectual Property Rights in Chinese Courts in 2009”. The court ordered compensation of about RMB 50.61 million, then the highest amount of patent infringement compensation in China.

2. Astellas vs. Chengdu List Pharmaceutical Co., Ltd.. Due to its technical and evidentiary standard related difficulties, the case was included in the Annual Report of the Supreme People’s Court of China as one of the top Intellectual Property Cases in 2013.

3. General Protecht vs. Bull Group. In this 2019 case in which a record amount of damages (RMB One Billion) is requested, we successfully represented the defendant.

4. Astellas Pharma vs. Zhejiang Hisun Pharmaceutical Co.. We successfully helped the plaintiff to obtain the first ever preliminary injunction in a pharmaceutical patent case in China. The case is named as one of the 15 Exemplary Cases of 2019 by the Beijing IP Court. It is also specifically mentioned by the Supreme People’s Court in its annual IP protection white paper as a “difficult and complex” case.
